TRIPS is one of the main agreements comprising the World Trade Organisation WTO Agreement. This Agreement was negotiated as part of the eighth round of multilateral trade negotiations in the period under General Agreement on Tariffs and Trade GATT commonly referred to as the Uruguay Round extending from to It appears as Annex 1 C of the Marrakesh Agreement which is the name for the main WTO Agreement.

The Uruguay Round introduced intellectual property rights into the multilateral trading system for the first time through a set of comprehensive disciplines. In respect of each of the areas of IP covered by the Agreement, each of the member nations is obliged to provide a minimum set of standards for protecting the respective IPR.

Under each of the areas of IP covered by the Agreement, the main elements of protection are defined, namely the subject-matter to be protected, the rights to be conferred and permissible exceptions to those rights, and the minimum duration of protection. Each member nation is obliged to provide domestic procedures and remedies with respect to protection of IPR.

The Agreement lays down certain general principles applicable to all IPR enforcement procedures. The Agreement also lays down certain other provisions on civil and administrative procedures and remedies, special requirements related to border measures and criminal procedures, which specify, in a certain amount of detail, the procedures and remedies that must be available so that right holders can effectively enforce their rights.

The Agreement on Trade-Related Aspects of Intellectual Property Rights , also known as the TRIPS Agreement, introduced global standards for enforcing and protecting intellectual property rights for patents. This agreement, which was put in place in , was expected to have the most impact on access to pharmaceutical medicines around the world. The World Trade Organization WTO is an international entity which deals with trade rules between countries.

Intellectual property rights are rights bestowed on individuals and companies for original creations. In , the WTO had member countries. By , the organization’s General Council made all documents public under GATT, the General Agreement on Tariffs and Trade. This move included all official TRIPS documents. Countries that become members of the World Trade Organization agree to abide by 18 agreements which established the organization.

As such, these countries cannot choose some agreements to follow and ignore others, save for a few non-obligatory agreements. All TRIPS Council administrators are also WTO members. The TRIPS Agreement is, to date, the most comprehensive intellectual property agreement. Prior to TRIPS, there were no international conventions that specified patent standards.

When negotiation began, more than 40 countries did not provide pharmaceutical patent protection.

Globalization and Health volume 15 , Article number: 88 Cite this article. Metrics details. We present a systematic review describing ex-ante and ex-post evaluations of the impacts of intellectual property provisions in trade treaties on access to medicine in low and middle income countries. These evaluations focused on multilateral and bilateral trade agreements. We ascertained which IP provisions impacting access to medicines were the focus of these evaluations.

We followed systematic review guidelines with 7 different databases to identify post ex ante and ex post evaluations of trade treaties on access to medicines in low and middle-income countries. The search strategy identified titles after removal of duplicates. We identified 14 studies that fulfilled all eligibility; 7 studies are ex-ante and 7 are ex-post.

The studies looked at medicine price and cost, affordability, welfare effects and speed of medicine market launch. Changes in intellectual property policy due to the implementation of trade agreements affect price, medicines expenditure and sales, consumer welfare, and ultimately the affordability, of medicines. The direction and magnitude of the price effects differ between ex-ante and ex-post studies.

Further, the reported impacts of policy changes due to trade agreements on medicine access seem clearly multifactorial. Both ex ante and ex post methods have advantages and limitations and, on balance, both types report, for the most part, an increase in price and a decrease in consumer welfare with imposition of intellectual property protection in trade agreements.
